TERMS AND CONDITIONS OF SALE
- The prices stated overleaf are the published prices issued by Spa De La Mare Ltd effective 01 January 2005 and exclude VAT, delivery and installation.
- A non-refundable deposit must be paid at the time of order.
- No order will be processed until a deposit has been received.
- Delivery includes insurance to the destination.
- Payment terms are 50% deposit with order and 50% prior to despatch.
WARRANTY
The Seller will repair or replace at its discretion any part or parts of the goods supplied by the Seller which is determined by it to be defective within 4 years for the Spa shell, and 1 year for all other equipment from the date of despatch from our factory. This shall include repair or replacement in the UK provided the following conditions are observed :-
- In the event of a claim under guarantee of any part, it must be returned to Spa De La Mare for inspection and assessment. Where convenient to the Seller it will carry out such inspection in-situ.
- The responsibility of the Seller under this guarantee is confined to making good components determined to be faulty, by repair or replacement. No liability is or will be accepted in respect of any other damage or loss caused through incorrect installation, operation, maintenance or neglect.
- The Seller accepts no responsibility for any item supplied but not manufactured by the Seller where any such item is subject to the warranty of its manufacture.
- Spa De La Mare Ltd accepts no responsibility whatsoever for any ancillary works.
This guarantee should be void if :-
- Damage occurs due to flooding, storms or other events such as acts of God, War, vandalism or general misuse or failure to operate the equipment in accordance with instructions supplied by the Seller or caused by incorrect installation, operation, maintenance or neglect.
- Discoloration or staining of the pool surface or corrosion of any equipment supplied by Seller occurs due to the conditions of the local water supply or atmosphere or failure by the Purchaser to maintain the pool water in accordance with the instructions supplied by the Seller or any chemical attack, or the addition of any chemicals to the water other than those recommended by the Seller for pool water care.
- Damage is caused by the settlement of heaving or other movement of subsoil or supporting structures or water levels in the adjacent subsoil.
The above does not affect your statutory rights.
